About Me

Working With Your Lawyer

About ten years ago, I was involved in a bad car accident. Another driver, who happened to be driving drunk at the time, smashed into the car I was driving. In addition to killing my daughter, the accident also left me paralyzed from the waist down. Although the case should have been cut and dry, the insurance company claimed that I was at fault. Fortunately, I worked with a lawyer who was able to fight my case for me. Without his help, I would still be paying off medical bills. I want to spread the word about the good that lawyers can do, which is why I created this website.

How An Auto Accident Attorney Can Help You Receive A Judgement Against An Underinsured Driver

If you were involved in a car accident in which you were injured and another driver was at fault, you may be able to file a personal injury claim against them and their insurance company. If your judgement or award is more than their insurance coverage, you can come after the other driver for the rest of the money. For example, if you were awarded $125,000 for medical bills and lost wages and their insurance coverage only covers $100,000, you can personally recover the remaining $25,000 against the driver. However, it can be challenging to recover money from another driver if they do not willingly give it to you. Fortunately, an auto accident attorney can help you recover the money you are awarded from another driver. Here are a few of the ways that the attorney can help you get the money you are entitled to.

Garnishing Their Wages

If you have a judgement against someone, you are able to garnish their wages. Only a percentage of their wages can be garnished to fulfilll the judgement and this amount varies by state. An attorney can file the paperwork and have it served properly on their employer so their wages can be garnished and the payment sent to you.

Seizing Their Bank Account

Another benefit to working with an auto accident attorney is that they can help you seize the debtors bank account. If you have a judgement against someone, you are typically able to seize their bank account. An attorney can work to locate their accounts and then file the paperwork with the bank to recover any funds that are available in the accounts and pay the money to you.

Filing a Lien Against Their Home

The last way that you are able to recover money against someone if you receive money from a personal injury claim is by placing a lien against their home or property. The downside to this is that you are not able to recover any money unless they sell the home. And any other lienholders, such as banks and creditors, are paid first. However, if the individual does not work and a bank account cannot be located, this can be the best way to recover your money. An attorney can complete the paperwork to place a lien against any houses or land they own on your behalf.

If you were injured in an auto accident and another driver is to blame, you may be able to file a personal injury claim against the other driver. An auto accident attorney can help you file the lawsuit and recoup any money you are awarded from both the insurance company and the other driver.
